THE MEANING OF "NEXT OF KIN"*

The term “Next Of Kin” simpliciter, does not confer the right of inheritance on the person so named. If so, of what use is the term?"


*INTRODUCTION*


The meaning and the legal implication of the term “next of kin” have been constantly misunderstood by the ordinary public. It appears, though erroneously, that many people think that once you are appointed the next of kin of a person, it automatically gives you the right to inherit the person’s estate upon his demise. In fact, many people think that, a next of kin gives an exclusive right over a person’s property.


The above erroneous belief and understanding of the term next of Kin has made many people to shy away from the need to make a Will. This is because, they think appointing a Next of Kin, is a way of naming your beneficiary. However, the above assumption is not in conformity with the law. It must be noted that, ignorance of the law is not an excuse.


*WHAT THEN IS THE MEANING OF THE TERM “NEXT OF KIN”?*


The term, next of Kin has been described as the nearest blood relative of a person. See JOSEPH v FAJEMILEHIN O.O & Anor (2012) LPELR-9849(CA). The term can also refer to a person who can be contacted or notified in cases of emergencies or eventualities. For instance, one of the forms that is usually filled while on transit, requires the information of next of kin. This is needed in case of any accident. In other words, where there is an accident involving that person, his next of kin shall be notified or informed.


Also, the term is constantly put into use by hospitals. In this case, next of kin means a person who can make medical decisions for a person who is incapacitated or unable to do so, during emergencies.


The term is also frequently used in financial documents by banks and other financial institutions. In this instance, next of kin means a person who can ensure that the proper steps are taken towards the recovery of the money held at the bank, at the demise of the owner. In other words, being a next of kin of a person, as regards his money in the bank, does not give a right to inherit such money, either partly or as a whole.


*WHAT IS THE LEGAL IMPLICATION OF THE TERM NEXT OF KIN AS IT RELATES TO THE LAW OF SUCCESSION?*


It must be noted that appointment of a next of Kin is not a substitute to the making of a valid WILL. The reason is because, when a person dies testate (that is, the person made a valid Will), the matter of next of kin is of no relevance. The estate of a deceased person who dies testate is distributed strictly according to the Will. Thus, his next of kin will only be entiled to his estate, if the WILL says so.


On the other hand, in a situation where the deceased died intestate (that is, without making a valid Will), the question of the distribution of his estate is governed by the law. The customary law/Islamic law or the Administration of Estate Law will apply depending on the kind of marriage contracted by the deceased. In other words, if the deceased contracted a statutory marriage (popularly known as court marriage), the distribution of his estate shall be governed by either the English Law or the Administration of Estate Law. See OBUZEZ V OBUZEZ (2007) 10 NWLR (Pt.1043) 430. It must be noted that the Administration of Estate Law provides for the order of inheritance which must be complied with strictly and a next of kin, is not among the categories of those entitled to inheritance in this instance.


In other words, Succession is regulated by law. It is only those entitled by law to inherit a deceased person’s estate that can do so. A next of Kin is not one of such persons. However, this is without prejudice to his right to inherit on a personal ground. Thus, if the person so named as a next of kin is the son of the deceased, he is entitled to inherit, not as a next of kin, but because he is the legitimate son of the deceased. Also, if the person so named as a next of kin, is also named in a valid Will made by the deceased, he is entitled to an inheritance not because he is a next of kin, rather, because, he is named in the WILL.


*CONCLUSION*


A next of kin, who is usually a blood relative, though not always, has no legal right of inheritance by virtue of his status as a next of kin simpliciter. However, it must be noted that the appointment of a next of kin is not a means or method of naming an heir. A next of Kin is not recognised as an heir under the Nigerian law of succession.


Therefore, next of kin, _stricto sensu,_ does not by any stretch of imagination, entitle the person so named an automatic right of inheritance. If the person so named as a next of kin is not entitled either by the WILL or by other laws of inheritance, to inherit, he cannot be conferred with the right of inheritance by the mere fact that he is named as a next of kin.


It is hereby submitted that when it comes to the law of succession, the term next of kin has no legal implication. It therefore does not confer the right of inheritance. Thus, it is erroneous and unlawful for anyone to claim any inheritance on the singularly reason that he is named as a next of kin. Such claims have no legal bases and are unfounded.

Two Nigerian singing divas, Tiwa Savageand Seyi Shay have engaged in a war of words with each other in public.


In a video posted on YouTube, the duo were seeing raining insults on each other in a hair dressing salon.


From their war words, it appears singer Seyi has been gossiping about Tiwa Savage and the latter heard of it and was infuriated.


But the whole drama began when Seyi had said “Hi” to Tiwa which had caused a confrontation from Tiwa who reminded Seyi Shay of the dirt she’s been saying behind her.


As a result, Seyi claimed she had never spoken ill of Tiwa but that’s she’s about to open her butt although trying not to be petty.


Lots of curse words were thrown at themselves freely with Tiwa demanding that Seyi open her butts and expose her if she has the guts.

A former Aviation Minister, Femi Fani-Kayode has confirmed the death of Temitope Balogun Joshua, founder of The Synagogue, Church Of All Nations (SCOAN).

Multiple reports on Saturday night suggested popular televangelist had died suddenly at the age 57.

But Fani- Kayode, a friend of the preacher who had earlier said the report of the Prophet’s death was fake news confirmed the death in a follow-up tweet.

The renowned gospel preacher known globally for his prophecies and healing of the sick as well as casting out of demons died at the age of 57.


The Peoples Democratic Party, PDP, Chieftain said TB Joshua’s daughter confirmed the death to him, adding that he is in pain

Twitter has expressed “deep concern” over the federal government’s decision to suspend its operations in Nigeria.



Sarah Hart, Twitter’s Senior Policy Communications Manager for Europe, Middle East and Africa, who made this known in a statement, said the company is investigating the development.


“The announcement made by the Nigerian Government that they have suspended Twitter’s operations in Nigeria is deeply concerning.


“We’re investigating and will provide updates when we know more,” the statement said.



Recall that the federal government suspended Twitter’s operations in a statement on Friday.


Lai Mohammed, Minister of Information, said the government was forced to act because of “the persistent use of the platform for activities that are capable of undermining Nigeria’s corporate existence”.

The Federal Government says it’s suspecting the activities of the social media giant, Twitter, following its decision to delete President Muhammadu Buhari’s tweet referencing the civil war.

Buhari had in a series of tweets on his verified Twitter handle, @Mbuhari, tweeted: “Many of those misbehaving today are too young to be aware of the destruction and loss of lives that occurred during the Nigerian Civil War. Those of us in the fields for 30 months, who went through the war, will treat them in the language they understand.”

Following several complaints, Twitter deleted the tweet, stating: “This Tweet violated the Twitter Rules”.

Reacting to the development, the Minister of Information and Culture, Alhaji Lai Mohammed, accused Twitter of double standard.

Mohammed said the social media giant has conveniently ignored inciting tweets by Nnamdi Kanu, the leader of the proscribed Indigenous People of Biafra (IPOB) and his cohorts.

He said Twitter ignored Kalu’s remarks that encouraged the killing of Police personnel and the show of similar biases during the ENDSARS protest where government and private properties were looted and set on fire, considering it human rights.

Mohammed, who wondered why the organization now found President Buhari’s tweet offensive, said Twitter’s role is suspect and Nigeria will not be fooled.

He said: “Twitter may have its own rules, it’s not the universal rule. If Mr. President, anywhere in the world feels very bad and concern about a situation, he is free to express such views. Now, we should stop comparing apples with oranges. If an organisation is proscribed, it is different from any other which is not proscribed.

“Two, any organisation that gives directives to its members, to attack police stations, to kill policemen, to attack correctional centres, to kill warders, and you are now saying that Mr. President does not have the right to express his dismay and anger about that? Are we the ones guilty of double standards? I don’t see anywhere in the world where an organisation, a person will stay somewhere outside Nigeria, and will direct his members to attack the symbols of authority, the police, the military, especially when that organisation has been proscribed. By whatever name, you can’t justify giving orders to kill policemen or to kill anybody you do not agree with.”

 A gentleman who rushed to purchase a sofa that was displayed for GHc 150 (N10k) online has realized it was a toy-sized one - It is indicated that the good took one month to be processed and was delivered to the gentleman on a motorbike - Ghanaians have been sharing their thoughts on this and Legit.ng has compiled some of the most interesting reactions .


 A young man in Ghana has gotten himself in an interesting situation after deciding to order a sofa he saw online going for a ridiculously low price. ADVERTISING Adu Kabena Alfred, a friend to the gentleman, indicated that the sofa was displayed on Jumia for (GHc 150) N10,000 and the young man took the opportunity to place an order for it. 


 Adu shared a photo of the sofa. 

 The good was processed for close to a month and when it arrived, it turned out to be a tiny model of the sofa which was delivered to him on a motorbike.
